WIN A WEEKEND IN MONACO DURING THE FORMULA-E GRAND PRIX RACE MAY 12th - 14th , WINNER DETERMINED BY DRAWING SORTS
Clause 1: Organisation CHARLET S.A.M., a company with a share capital of 330,000 euros, Trade Registry number: ND59S00811, located at 2 rue du Rocher – 98000 Monaco, hereinafter, “the Organiser”, is organising a free Sweepstakes, with no purchase required, entitled “Mario Bertulli Grand Prix Electrique” (hereinafter, “the Sweepstakes”) from 01 March 2017 until 31 March 2017, inclusive.
Clause 2: Participation Participation in this free Sweepstakes, with no purchase required, is only open to Mario Bertulli customers residing in one of the following European Union countries* and aged 18 and over on 1 March, 2017, excluding those who are members or employees of the Organiser (CHARLET S.A.M.), as well as their families (spouses, parents, children or siblings), or partners and subcontractors. *Places of residence falling within the scope of the Sweepstakes: Monaco, Metropolitan France, Italy, Germany, Austria, Switzerland, Belgium, the Netherlands, Luxembourg, Poland, United Kingdom, Ireland.
Clause 3: Terms To enter, simply fill out the entry form that Mario Bertulli customers will have received in their March package, and accept the game rules. To validly participate, the entry form must be filled out correctly, with all sections completed. Any incomplete or illegible entry and/or those not pertaining to a Mario Bertulli customer and/or those not residing in one of the countries mentioned above and/or those sent after the 31 March 2017 deadline (authenticated by date of postmark), or in a format other than as required, shall be deemed null and void.
and registering on the dedicated Sweepstakes page. To validly participate, participants must enter their details and fill out the form correctly, completing all fields, not forgetting to accept the terms of settlement, by 31 March 2017, at 11:59:59 P.M. (Monaco CET) at latest.
Clause 4: Provisions The Sweepstakes winner shall be invited to spend a weekend in the Principality ofMonaco, with the person of their choice, during the Formula E Grand Prix, from Friday 12May until Sunday 14 May 2017, over the weekend for a maximum value of € 3,500.
This weekend shall include:
- The return trip from and to the place of residence to/from Nice by train, or to/from a European capital to/from Nice, by plane. The Organiser alone shall arrange tickets, which shall be neither transferable nor exchangeable, nor refundable. The winner and the person of their choice shall ensure their availability at the transportation times notified to them by
the Organiser. Any boarding delay shall automatically cancel the weekend: no other ticket shall be issued;
- Transfers to/from Nice airport from/to the Columbus hotel in Monaco;
- Hotel accommodations reserved for 2 people, on Friday 12 May 2017 and Saturday 13 May 2017 (with breakfast included);
- Access to the private terrace of the Venturi enclosure, where Mario Bertulli is one of the exclusive partners, in the race on Saturday 13 May 2017.
The Organiser shall arrange the transport reservations for the winner and guest. Both participants must depart from the same city, the city where the winner resides. Depending on the country/city of residence, the Organiser shall reserve either 1st class train tickets or economy class air tickets, with the return tickets not exceeding €1000 per person.
The Winner and guest must be flexible with regard to departure times.
All other fees, at the hotel or in the Principality of Monaco, shall be the sole responsibility of the participant and their guest.
Under no circumstances may the winner transfer this weekend to a person of their choice. If the winner is unable to participate in this weekend, his/her entry shall be forfeited, and another entry shall be drawn.
Clause 5: How to get hold of an entry form? Any Mario Bertulli customer can apply for one, FREE, BY WRITING between 01 March 2017 and 20 March 2017 inclusive (authenticated by date of postmark), indicating his/her full name and complete address, legibly, to the following address: CHARLET S.A.M./Sweepstakes - BP9 – 98000 Monaco. Only one entry per application shall be sent, and only one application per household shall be honoured. Any application by any other means (fax, telephone or email, etc.) shall be rejected. Beyond the 20 March 2017 deadline, taking any postal delays into account, the Organiser shall not accept any other request for application. Or by connecting on the web, at https://www.mariobertulli.co.uk/content/371-win-a-weekend-in-monaco, and completing the entry form directly online. After having accepted the game rules and confirmed their registration, the entrant shall immediately receive a message at the email address provided during registration, indicating that he/she is registered in the 5 April 2017 Sweepstakes, if registered before 31 March 2017, at 11:59:59 P.M. (Paris-France GMT).
Warning: the entrant must fill out the online registration form provided carefully. The Organiser reserves the right to reject, disqualify or invalidate the participation of any person not complying with the provisions of these rules, and, in particular, if the information and details provided by the entrant are invalid, erroneous or incomplete.
By registering, the entrant expressly authorises the Organiser to use his/her first name and/or initial of his name and/or name or number of the area where he/she resides, in order to reveal the result of the Sweepstakes. This authorization is given by the entrant for a period of 8 months from the date of the Sweepstakes, that is, from 5 April 2017 until 5 December 2017.
Clause 6: Naming the winners A draw will be conducted on 5 April 2017 by The Office of Maître Escaut-Marquet, bailiff in Monaco, or one of its associates. It will be taken from among all entries that meet the conditions listed in Clause 3 above, in paper and in electronic format, which are received and validated by 31/03/2017 at latest.
The winner of the Sweepstakes shall be notified by the Organiser by letter, email and telephone. Failing any response from the latter within eight days from date of confirmation his/her winning, the winner shall be disqualified and the prize, as defined in Clause 4, forfeited. A new draw shall then be made by a bailiff. This may not be paid in cash or in any other compensation of any kind, and is not transferable.
Particularly in cases of force majeure, or for reasons beyond its control, the Organiser may be forced to change the nature of the weekend to be won when already underway, and replace it with another, of at least equivalent value. This substitution may not lead to any refund for the winner in any form.
The winner shall designate as address for service the address indicated on the Sweepstakes entry, and shall authorise any verification of identity and domicile (postal and email addresses). Any erroneous information as to identity or address shall lead to the invalidation of the winner and any entry by the latter.
Clause 7: Statutory Filing The rules have been filed with HUISSIERS DE JUSTICE ESCAUT-MARQUET SCP – 29 boulevard des Moulins – 98000 MONACO.
The rules may be modified at any time, in the form of an amendment by the Organiser, in accordance with the conditions stated. This amendment shall be registered with HUISSIERS DE JUSTICE ESCAUT-MARQUET SCP - 29 boulevard des Moulins – 98000 MONACO, the custodian of the rules before the publication thereof. Amendments shall enter into force after being put online, and any entrant shall be deemed to have accepted these by virtue of having entered the Sweepstakes, as from the date of entry into force of the amendment. Any entrant not accepting the amendment(s) made must no longer participate in the Sweepstakes.
Clause 8: Internet Connections and Usage Participation implies an awareness and acceptance of the characteristics and limitations of the Internet, the lack of protection of certain data against possible misuse or piracy, and risks of possible contamination by viruses circulating on the network.
The Organiser denies any liability in the event of misuse or incidents linked to the use of the computer, to internet access, or to the maintenance or malfunction of the game servers, the telephone line or any other technical connection, or linked to sending the sweepstake forms to an incorrect or incomplete address.
Clause 9: Advertising and promotions
Dissemination of the name (or initials) and/or first name and/or name of the area where the sweepstake winner resides shall be made by the Organiser for advertising purposes, without this conferring any right on the winner to remuneration or any other benefit, other than provision of the prize. Such dissemination may occur in any advertising media for a period of 8 months from the date of the Sweepstakes on 5 April 2017.
Article 10: Disputes and liability Participation in the Sweepstakes implies acceptance of the rules in their entirety, without reservation. If one or more provisions of these rules were to be declared invalid and unenforceable, the remaining rules shall remain in full force and effect; in the event of a difference between the version of the rules filed in the office of the Bailiff of Justice and the version of the rules available online, only the version filed with the Bailiff shall prevail. Any inaccurate or false declaration or any fraud shall result in disqualification.
No request, by phone or in writing, concerning the interpretation or application of these rules, the Sweepstakes mechanisms or modes, as well as concerning the name of the winner, shall be replied to. In case of a dispute, only a registered letter with acknowledgment of receipt within 1 month after announcement of the result shall be admissible.
The Organiser may cancel or suspend all or part of the Sweepstakes if it appears that fraud has occurred in any form whatsoever, including concerning information technology in the context of participation in the game. In this case, it reserves the right not to award the prize to the fraudster and/or to take action before the competent courts against the perpetrators of such fraud.
Clause 11: Agreement relating to proof Except in cases of obvious errors, it is agreed that the information resulting from the Organiser’s Sweepstakes systems shall have probative force in any dispute over the connection elements or the handling of such information relating to the Sweepstakes.
Clause 12: Applicable Law Participants are subject to the Monegasque regulations applicable to games and contests. Any dispute that cannot be settled amicably shall be submitted to the Monegasque court, in accordance with the Civil Procedure Code.
Clause 13: Data Protection The personal information collected as part of these Sweepstakes shall be handled in accordance with the Data Protection Act of 6 January 1978. Pursuant to Article 27 of the same, all Sweepstakes participants have the right to access or to correct data concerning them. Any request for access, correction or objection must be addressed to the Organiser.
Clause 14: Literary and artistic property rights In accordance with the laws governing literary and artistic property rights, the reproduction or representation of all or part of the component elements of these Sweepstakes are strictly prohibited. All trademarks mentioned are the registered trademarks of their respective owners.
